Terms of Use

1. Who you are agreeing with

Do This Next (dothisnext.lol) is operated by Simon Berriman, sole trader (freelance), Karl-Rothe-Str. 4, 04105 Leipzig, Germany. Contact: hello@dothisnext.lol. Full details are in the Impressum. Using the service means these terms apply. If you don’t want them to, don’t use it.

2. What the service is

Do This Next analyses publicly available information about your product and recommends marketing actions — one at a time, with the reasoning shown. It is advice, produced by a mixture of automated analysis and editorial judgement, and you decide whether to act on any of it.

It is not an agency, not a marketing service that acts for you, and not professional legal, tax or financial advice. We are not your agent and we do not represent you anywhere.

3. Recommendations are informational, and the decisions stay yours

Every recommendation is a suggestion based on what we could see and what you told us. Automated analysis can be wrong, out of date, or confidently mistaken about your business. You remain responsible for every marketing, commercial and business decision you make, including the ones you make because we suggested them.

We do not guarantee traffic, signups, users, revenue, rankings, attention or any other marketing result. Nobody honestly can, and anyone who does is selling you something else. Nothing on this site is a promise of a particular outcome.

4. Your account

Accounts arrive with Founding Access. When they do: keep your credentials to yourself, one account per person or business, and tell us if you think someone else has got into yours. You are responsible for what happens under your account and for the accuracy of what you tell us about your product — we build recommendations on it, so a made-up answer produces made-up advice.

5. Using it properly

You agree not to:

• submit a URL you have no right to ask us to analyse — your own products, or ones you are genuinely authorised to work on;
• use the service to spam, harass, impersonate anyone, post fake reviews or astroturf. We will never recommend any of that, and drafts we give you are not a licence to do it;
• break the rules of whatever platform you are posting on — those rules are between you and them, and following them is your job;
• scrape, resell or redistribute the service, attempt to extract its prompts or source, or use it to build a competing product;
• abuse the free Product Check with automated submissions, or work around the rate limits;
• use the service for anything unlawful.

6. What you submit, and what we do with it

Your website and your business stay yours. We claim no ownership of your product, your content, your brand or your site. By submitting a URL you are asking us to fetch publicly available pages from it and analyse them, and you are confirming you are entitled to ask.

You grant us only what we need to do the job: permission to fetch, store and process those public pages and the information you give us, in order to produce and improve the analysis and recommendations we provide to you. That is the whole licence. It ends when we delete the data — see the Privacy Policy, which also covers how AI processing works and which providers are involved.

We fetch one page: the address you gave us. We do not crawl the rest of your site, we never attempt to reach anything behind a login, and we identify ourselves honestly as DoThisNextBot/1.0 so you can see us in your logs. Exactly what that request does and does not do is set out in the Privacy Policy. Block that user agent, or email us, and we stop.

Drafts and recommendations we produce for you are yours to use for your own business. We may keep aggregated, de-identified patterns about what works for which kinds of product — never your identifiable business data, and never anything another customer could trace back to you.

7. Your Product Check is private

A Product Check has an unguessable link, is not indexed and is not listed anywhere by us. Sharing that link is your decision. Treat it like a password: anyone who has it can see the check.

8. Money

The Product Check is free. There is no trial, because the free thing is a different product rather than a countdown. Founding Pro is a monthly or annual subscription charged through Stripe. What you pay is the price displayed at checkout, plus any applicable taxes, in the currency shown there — we price natively in more than one currency, so the amount depends on where you are.

You can cancel at any time and keep access until the end of the period you have paid for. We don’t refund part-periods as a matter of course, but if something has genuinely gone wrong, email us and we will sort it out like adults. Nothing here affects statutory consumer rights you may have where you live, including a right of withdrawal if one applies to you.

Founding pricing is honoured for as long as your subscription stays active. Cancel and come back later and you come back at whatever the price is then.

9. Availability and change

This is an early product. We will try hard to keep it up and we will tell you when it isn’t. There is no uptime guarantee. We may add, change or remove features, and we will give reasonable notice of a material change where that is practical. Features described as coming during Founding Access are our intention, not a commitment to a date.

10. Intellectual property

The site, its design, its copy, the software and the analysis methodology belong to us. These terms give you the right to use the service, not to copy it. Trade marks and content belonging to third parties remain theirs.

11. Third-party services

We rely on other providers — hosting, database, the model provider that performs the analysis, payments — and they are listed in the Privacy Policy. Where a recommendation points you at a platform, that platform’s terms are between you and them. We are not responsible for what third-party services do or for their availability.

12. Ending it

You can stop whenever you like, and close your account when accounts exist. We may suspend or end access where the service is being used to spam people, to abuse the free Product Check, or in breach of these terms — with notice and a reason, except where the law or an ongoing abuse makes notice impossible first.

13. Liability

We are liable without limit for intent and gross negligence, and for death, personal injury or damage to health. We are also liable under the German Product Liability Act where it applies, and where we have given a guarantee.

For ordinary negligence, we are liable only where we breach an obligation that is essential to performing this contract, and then only for the foreseeable damage typical of this kind of contract. Beyond that, and to the extent the law permits, we are not liable — in particular not for lost profit, lost revenue, lost users, wasted marketing spend, or any other indirect or consequential loss arising from a recommendation you chose to act on, or from the service being unavailable.

Nothing in these terms limits liability that cannot be limited under applicable law, and nothing limits your statutory rights as a consumer.

14. Changes to these terms

We may update these terms. The date at the top changes when we do, and if a change materially affects you and you have an account or a subscription, we will tell you before it takes effect. Continuing to use the service after that means the new terms apply.

15. Governing law

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Where you use the service as a consumer, this choice does not deprive you of the protection of the mandatory law of the country you live in, and you can bring proceedings there. For business users, the courts with jurisdiction are those at the operator’s registered place of business in Leipzig, Germany.
